How do I know if behavior is considered harassment?
Unwelcome behavior that can affect your performance at work could be considered sexual harassment. The Equal Employment Opportunity Commission (EEOC) established guidelines for determining when unwelcome behavior in the workplace is considered harassment:
- If acceptance or rejection of the behavior is made a condition of or is the basis for decisions made which affect the victim’s employment
- If the behavior affects the victim’s work performance
- If the behavior creates a hostile or intimidating work environment
What should I do if I have experienced harassment?
If you believe you, or someone who know, are a victim of harassment you should begin by collecting as much evidence as possible. If there are witnesses to any of the incidents, their reports will be helpful as well. Gathering photos, voicemails, emails, notes, videos, or any other form of proof will help build your case. Be as specific as possible in your documentation of each incident as this will help your attorneys make a better case.
